Terms of Service

PLEASE READ THIS AGREEMENT CAREFULLY. BY CLICKING ON THE BUTTON ON THE SIGN UP FORM, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT AND ALL TERMS AND CONDITIONS INCORPORATED BY REFERENCE IN THIS AGREEMENT. YOUR USE OF THE SERVICES CONSTITUTES ACCEPTANCE OF THIS AGREEMENT.

1. Customer Content.
NoFeeHost services may be used for lawful purposes only. While using NoFeeHost's Services, Customer may have access to services that allow you to send or post materials ("content") and make that content available to others on the global Internet. Customer may not submit, publish, or display on the NoFeeHost Network any defamatory, illegal, abusive, obscene, infringing, or threatening content. In addition, Customer may not submit, publish, or display any content in violation of any US laws, Federal, state or local. Customer is solely responsible for the content that they make accessible while using NoFeeHost's servers and networks. Customer may not use the service to assist any other person or entity to violate any Federal, State, or Local laws, ordinances, or regulations.
NoFeeHost is not obligated to monitor the network for the purpose of examining Customer's content. Customer hereby acknowledge that if NoFeeHost is made aware of content that is determined to be, at the sole discretion of NoFeeHost, unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, NoFeeHost has the right, but not the obligation, to edit, remove or deny access to such content. NoFeeHost may disclose any content or records concerning customer's account as required to satisfy any legal requirement, regulation, government request or court order.
Pornography and sex-related are expressly prohibited on NoFeeHost servers. This includes implying sexual content, display of nudity, or any link to adult content. This is also true for sites that promote illegal activity of any type or content that may be damaging to NoFeeHost servers or any other servers on the Internet. Links to such materials are also prohibited. In addition, the sale of or promoting bulk email services are not allowed. Non-acceptable content or links include but are not necessarily limited to:

Adult Content Sites - Any pornographic material, links to adult sites, or advertisements for adult sites.
Pirated Software Sites (Warez) - Any software that is copyrighted and not freely available for distribution without cost; i.e. ROMs, ROM Emulators and MPEG Layer 3 files (MP3).
Copyright Violations - Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer.
Hacking/Phreaking - Includes sites with material, links, or resources for hacking, phreaking, viruses, or any type of site that promotes or participates in willful harm to Internet sites or providers.

The designation of any materials as described above is left entirely to the discretion of NoFeeHost.

2. Technical Support.
Technical support e-mails sent to NoFeeHost are monitored Sunday from 3:00 p.m. till 10:00 p.m.; and Monday – Friday from 9:00 a.m. till 8:00 p.m. The average response time for support requests is one business day.

3. Unsolicited Email (Spam).
UCE/UBE or "Spam" originating from a NoFeeHost account, or associated with a NoFeeHost account, is not tolerated. This includes any e-mail that promotes web sites hosted on a NoFeeHost account but is sent from an e-mail address not associated with that NoFeeHost account. Client shall not use their NoFeeHost services for chain letters, junk mail, bulk-email, or any use of distribution lists to any person who has not given specific permission to be included in such a process. NoFeeHost reserves the right to deactivate or terminate any account(s) upon any indication of such activity without notice.

4. CPU Usage.
Customer agrees that Customer shall not use excessive amounts of CPU processing on any of NoFeeHost's servers. Any violation of this policy may result in corrective action by NoFeeHost, including termination of this Agreement, which actions may be taken in NoFeeHost's sole and absolute discretion.

5. Amendment.
NoFeeHost may amend, modify or update this Agreement or the Usage Policy at any time in its sole discretion, and Customer shall be bound by any such amendment, modification or update. NoFeeHost may, but is under no obligation to, provide notice of any amendment, modification or update of this Agreement or the Usage Policy. If any material modification to this Agreement or the Usage Policy is unacceptable to you, you may terminate your subscription. However, if you do not terminate the Agreement, or if you continue to use the Services following effectiveness of the modification, your continued use will mean that you have accepted that modification. NoFeeHost reserves the right to amend its service offerings and add, delete, suspend or modify the terms and conditions of the Services, at any time and from time to time, and to determine whether and when any such changes apply to both existing and future customers.

6. Force Majeure.
NoFeeHost shall not be liable for failure or delay in performing its obligations hereunder if such failure or delay is due to circumstances beyond its reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provision of the Services.

7. Disclaimer of Warranty.
NoFeeHost MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO WARRANTIES OF NON-INFRINGEMENT, MERCHANTIBILITY OR FITNESS FOR A PARTICULAR USE) WITH RESPECT TO THE SERVICES IT PROVIDES. NoFeeHost makes no warranties of any kind, expressed or implied for services we provide. NoFeeHost disclaims any warranty or merchantability or fitness for a particular purpose. NoFeeHost is not responsible for any interruption in service or down time that may occur, whether due to external network disruptions or negligence of NoFeeHost's. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by NoFeeHost and its employees. NoFeeHost reserves the right to revise its policies at any time.
